organization, with headquarters in Nashville and an international office in New York.
- NMPA National Music Publishers Association - also the Harry
Fox Agency, Inc. Good place to start if you need a mechanical license for
published music for your CD. Lyrics and sheet music too.
- Performing rights and you! - Editorial comment from your
webmeister - FLAME ON - Musicians who write and record music for a living make
money from (among other things) performance rights fees. They get money from publishing
rights, mechanical rights, synchronization rights, performing rights (radio, nightclubs,
television, movies, concerts) etc. The details of this legal topic can be found in the URL
links above. Local venues that hire musicians are required to pay performing rights fees.
The fees vary depending on the size of the venue. But they should be paying them for live
music performances as well as recorded music played in the background. That's why you
don't have to pay when you play. Some venues in this town often choose not to pay
their dues thinking that if they hire people who play only 'original music' (ie. no
covers) they can get away without paying. This is a typical trend in small towns (like Ft.
Collins) that suddenly become big towns (like Ft. Collins) and all of a sudden get 'on the
map' for ASCAP and BMI. Be careful playing in a venue that is 'dueless', or clueless
whichever you prefer. If you have worked hard to write original music, and get it
published, and you belong to ASCAP, BMI, or are a publisher yourself , you are
basically getting ripped off if the club hires you thinking they don't have to pay
their dues for 'original music'. Club owners are fun aren't they? Also, if you record
music for a demo, and it's a cover tune, you technically owe the publishers and
artist a cut IF you sell this demo for profit. It's simple and fairly cheap to get the
rights to use someone else's tunes. Just link to the NMPA
site above and you can get a mechanical license for limited
distribution (2500 or less) via the web!. or Contact
the publishers to help you get 'mechanical rights' for the songs. Pay a few pennies
per tune per tape, reference the publisher or artist on your labels, and, bwalla,
you're legal. Some artists will just sign the rights to you for a small fee - just call
the artist if you need to. Ft. Collins thinks it's pretty hip now that we have bagles,
Juice Bars, and micro brews. If we're going to play the game we should play it
right. Pay musicians fairly for live performances, and pay your dues!. FLAME OFF -
